3.1 Product Description
We offer Minecraft and Hytale plugins, server setups, and related digital products. All products are delivered digitally and are provided "as is" unless otherwise specified.
3.2 Pricing and Payment
All prices are displayed in the currency specified on our store. We accept payments through PayPal and Stripe. By making a purchase, you authorize us to charge the payment method you provide.
3.3 Licenses
Purchased products are licensed to you, not sold. Each license grants you the right to use the product according to the specific license terms provided with that product. Licenses are non-transferable unless explicitly stated otherwise.
4. Intellectual Property
All content on our website and in our products, including but not limited to code, designs, logos, documentation, and media, is owned by Blueva or its licensors and is protected by copyright and other intellectual property laws. You may not:
- Redistribute, resell, or share our products without authorization
- Reverse engineer, decompile, or disassemble our products (except where permitted by law)
- Remove or alter any copyright notices or branding
- Use our products to create competing products or services
5. User-Generated Content (Blue Arcade Modules)
Our Blue Arcade product allows community members to create and submit custom modules. By submitting content, you agree that:
- You own or have the necessary rights to submit the content
- Your content does not infringe on any third-party rights
- Your content complies with our Community Guidelines (see Section 6)
- We may review, moderate, or remove your content at our discretion
- You grant us a non-exclusive license to distribute your content through our platform
All user-submitted modules are reviewed and moderated by the Blueva team to ensure they are free from malicious files, inappropriate content, and security vulnerabilities.
6. Community Guidelines and Prohibited Conduct
When using our services or participating in our community, you must not:
- Use discriminatory language or hate speech targeting individuals or groups based on race, ethnicity, national origin, sex, gender, sexual orientation, religious affiliation, or disability
- Engage in harassment of any kind, whether organized, participated in, or encouraged
- Make threats or acts of violence towards other users
- Share inappropriate content, including adult content, private information of others, content promoting suicide or self-harm, violent or gory images, or animal abuse
- Share content that infringes upon the rights or intellectual property of others
- Upload or share malicious files, including viruses, malware, or any other harmful software
- Impersonate other users, staff members, or moderators
- Engage in spamming or flooding
- Attempt to gain unauthorized access to our systems or other users' accounts
7. Refunds and Returns
Due to the digital nature of our products, all sales are final. Refunds may be issued at our sole discretion in the following circumstances:
- The product is fundamentally broken or non-functional
- The product was incorrectly described or does not match its description
- Technical issues prevent you from accessing the product
Refund requests must be submitted within 14 days of purchase with a detailed explanation of the issue.
8. Support and Updates
We provide support for our products through our Discord server and documentation. Support does not include custom development or modifications beyond the product's intended functionality. Product updates are provided at our discretion and may be free or paid depending on the nature of the update.
9. Limitation of Liability
To the fullest extent permitted by law, Blueva and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services. Our total liability shall not exceed the amount you paid for the product in question.
10. Disclaimer of Warranties
Our products and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our products will be error-free, secure, or uninterrupted.
11. Termination
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for violating these Terms of Service or for any other reason we deem appropriate.
12. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes by posting a notice on our website or through email. Your continued use of our services after such changes constitutes acceptance of the updated terms.
13. Third-Party Affiliations
Blueva is not associated with, endorsed by, or affiliated with Mojang Studios, Microsoft Corporation, Minecraft, Hytale, or Hypixel Studios Canada. All trademarks are the property of their respective owners.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable international laws for digital commerce. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction where Blueva is registered.
